CPS said she hadn't commited an offence!!! So pulling out on someone and killing them isn't an offence these days? Unbelievable!!! The real police wanted her done . The fact that she lied and has the gawl to smile/ laugh on her way to court kinda tells you what a complete turd of a human she is. My thoughts go out to the guys family who must be royally pissed off with our unbalanced judicial system.

Our judicial system sucks big time

Look at the f###ing pics she pulled out infront of him it is causing death by dangerous driving no more no less

No further comment from me on this i been drinking and don't want to get banned over this

Does it really matter whether she is a policewoman or special? She commited an offence simple as. Thoughts go out to the family - doesn't really give you much faith in the justice system

Not likely here Dai, although making criticism or asking questions of the police will get you banned at "the other place" as I know to my cost :)

The decision to prosecute (or not) rests with the CPS and not the police.

In a statement CPS Wessex said there was “insufficient evidence to provide a realistic prospect of conviction”.

It read: “In order to charge Ms Carpenter with an offence of death by careless driving or death by dangerous driving we had to prove that her driving fell below or far below the standard required at the time of the collision.

“Two drivers who were the closest to the collision stated that when Ms Carpenter pulled out her manoeuvre was safe and did not inconvenience them. This supported Ms Carpenter’s account, which stated that she checked both ways before pulling out.

“The evidence showed that Ms Carpenter was using her phone whilst driving but Ms Carpenter stated that her phone was positioned on her lap on loud speaker.

“We also took into consideration that there was no evidence to support that Ms Carpenter was holding her phone at the time of the collision.

“Having considered all the available evidence, we decided that there was insufficient evidence to prove that Ms Carpenter’s driving fell below or far below the standard required.

Motorcyclist on the main route, car pulls out into his path causing an impact and his demise QED car is at fault, last time I checked the rule was something along the lines of not causing another person to alter speed or direction.

The same sort of thing is what killed my brother, except in his case it was a taxi that pulled out. As far as I'm concerned if someone pulls into the path of another vehicle they're automatically at fault!

Sadly because this was while Brunstrom was in charge the life of a motorcyclist was not considered important so the taxi driver didn't even have to attend court or have any charges brought against her, despite to me, the clear fact she pulled into the main road that my brother had legally the right of way on.

One of the consequences of the taxi driver not being charged was that the incident becomes a knock for knock and my sister in law and my niece had the compensation for loss of a husband and father cut in half :(

Sorry for your loss Steve.

However you did not mention that this was reported at the coroners court.

Sgt Colin Dobbins, senior collision investigator for North Wales Police, said there was a possibility the sun had affected Mr Blacknell’s view.
He said: “We must consider the actions of both persons involved, but that is a matter for the court.
He said Mr Blacknell was travelling at about 50mph in a 30mph zone.

The fact the lady wasn't charged would have not had any influence on his families payout and any insurance company would be looking to reduce its payment. His speed in a 30 limit would be an obvious factor to reduce any payout.

It would also obviously be a factor in deciding whether to prosecute or not. For example the lady driving would be pulling out expecting traffic to be moving at around 30 mph and not at 50 mph.

The Chief Constable in place at the time would have had no effect on the quality of the investigation and it seems that the officers involved did a very thorough and fair job.

Actually the police investigator didn't say that at all, the newspapers mis reported what was actually said (what a surprise) .... what he actually said was they couldn't determine what speed my brother had been travelling at, all they could say was that it was between 30 and 50 mph and it could have just as well been 30 as it could 50.

Knowing my brother, I'm fairly sure that as this was outside a school he'd have actually been at 30, which was backed up by a person he overtook earlier in that he was not roaring off just performed an overtake in the NSL section and appeared to be travelling within the limits.

As they were unable to acertain the speed or attribute blame I'm not sure anyone did a particularly good job, and if you believe the direction the area Chief Constable points his officers at doesn't have a bearing on the standard that's applied then I suggest you're being naive.

Anyway I'm getting drawn into a discussion with you (which I'd promised myself not to do again) and that's pointless as you've proven yourself on all occasions to be provocative, rude and insulting to members of this group, in short trolling, so I'll leave it at that.
